ADT Security Services Files Lawsuits to Protect its Trademark from Copy Cat Companies Trying to Confuse Consumers

Boca Raton, Fla. – October 8, 2010
– ADT’s federally registered blue octagon trademark which symbolizes high quality and peace of mind protection for millions of residential and business customers, is being defended through a series of lawsuits ADT recently filed against companies whose use of similar marks was likely to confuse consumers.

ADT filed lawsuits which resulted in permanent injunctions against three companies prohibiting them from any further use of ADT’s blue octagon trademark:

• Advanced Design Technologies, Boca Raton, Fla.

• Moore Protection Home Security, Redondo Beach, Calif.

• IC Realtime, Pompano Beach, Fla.

The lawsuits allege that these companies purposely copied ADT’s blue octagon trademark to capitalize on ADT’s market leading reputation to attract consumers who might think they were dealing with the real ADT.

David Bleisch, ADT Vice President and General Counsel, states that the company will continue filing more lawsuits against companies that infringe on its intellectual property. “As the number one security company in America, ADT is committed to vigorously protecting its valuable, federally-registered blue octagon trademark,” said Bleisch. “We want consumers to know they are doing business with the authentic ADT and not an imposter.”

Such lawsuits seek monetary damages as well as requirements that the offending companies cease using the inappropriate materials and immediately remove them from public view. In some cases, corrective advertising can also be imposed.

In addition to yard sign violations, ADT regularly monitors websites to identify companies who infringe on its trademark. In several cases over the past few years, ADT has pursued and successfully stopped the infringing companies which were required to remove the unauthorized ADT trademark from online promotion.
